Delta-9 THC is a controlled substance under federal law, and products containing Delta-9 THC above the legal limit of 0.3% are considered illegal and classified as marijuana. However, products that contain Delta-9 THC below 0.3% are considered hemp-derived and are legal to sell and ship under the 2018 Farm Bill.
The 2018 Farm Bill legalized the production and sale of hemp and hemp-derived products, including those containing Delta-9 THC below 0.3%. This means that as long as a product meets the criteria set forth by the Farm Bill, it is legal to sell and ship throughout the United States. All products that RAD produces are below .3% THC, including our hemp derived THC gummies. All COAs including our THC Gummy COA is on our Lab Reports page.
To comply with the 2018 Farm Bill, hemp-derived Delta-9 THC products must be sourced from industrial hemp that is grown in accordance with state and federal regulations. Additionally, these products must be tested by a third-party lab to ensure that they contain less than 0.3% Delta-9 THC and are free from contaminants. All the hemp RAD works with is Colorado derived and we have thorough testing throughout the entire process. We test the incoming hemp for potency, the extract produced is full panel tested and the final products are tested for potency and microbs.
It is important to note that while Delta-9 THC products below 0.3% are legal to sell and ship, they may still be subject to state and local regulations. It is important to check your state's laws regarding Delta-9 THC products to ensure that you are in compliance with all applicable regulations.
